随着交互式网络电视(IPTV)的发展,司法实践中已经出现多起涉及IPTV"回看"模式版权侵权的诉讼案件。从侵权行为构成要件的角度分析,未经授权的"回看"模式属于侵犯著作权的行为,不受合理使用制度的庇护。"回看"是典型的"交互式传播",而非"广播",侵犯了著作权人的信息网络传播权。

With the development of Internet Protocol TV （ IPTV ） , many cases involving IPTV＂ time - shifting＂ mode have appeared in judicial practice. From the perspective of the constitutive elements of tort, unauthorized ＂time - shifting＂ mode is a violation of copy- right, which is not under the protection of reasonable use system. ＂Time - shifting＂ mode is a typical ＂interactive communication＂ rather than ＂broadcasting＂, so it violated copyright owner＇s information network dissemination rights.
