关于卫生监督机构现状的思考

Thought on the status of health supervision institutions

卫生监督体制改革已经进行了16年,但现实中的卫生监督体制和当年"卫生监督体制改革"相关文件中要达到的目标还有一定的差距,而且在现实工作实践中,卫生监督机构又出现了机构名称不统一、人员编制落不实、法律地位不明确、保障措施靠不住、人员能力不适应、工作机制不顺畅等问题,使相关的卫生法律不能有力地贯彻落实。要保证各项卫生法律和行政首长的管理意志顺利落实,须要继续加强卫生监督体制建设,确立卫生监督机构法律地位、保证政令畅通、理顺管理体制、完善相关政策等,实现执法有保障、有权必有责、用权受监督、违法必追究、侵权须赔偿权责统一的依法治国目标,才能发挥卫生监督机构卫生行政执法监督职能,保证各项卫生法律和政策得到顺利贯彻落实。

The health supervision system reform has been carried out for 16 years,but there is a certain gap between the health supervision system in reality and the goal in the document of Health Supervision System Reform.In real practice,health supervision agencies have such problems as not unified name of supervision agencies,not implemented manning quotas,unclearly legal status,unreliable support measures,personnel ability,working mechanism,etc,which made health laws and regulations can＇t been effectively implemented.To ensure the health laws and regulations and the executive management can be implemented smoothly,it＇s necessary to continually strengthen health supervision system construction,establish the legal status of health supervision institutions,to ensure government＇s decisions are carried out without fail,straighten out the management system,improve the relevant policies,to realize the goals of Law enforcement guaranteed,power comes with responsibility,the right subject to supervision,illegal be investigated,tort must compensate unity responsibilities of the rule of law,in order to play the health supervision institutions in the administrative law enforcement supervision,to ensure the health laws and regulations and policies can be successfully implemented.
