摘要
任何时代任何国家都不存在十全十美司法法制度能够保障每一个案件都铁证如山,司法之剑难免误伤,重要的是我们如何去完善和纠正错案。近些年大批冤假错案不断被曝光,错案追责的呼声也越来越高。笔者结合我国目前错案追责的启动主体不明确、错案发现难、被告人申诉难的现状和相关资料进行归纳和对比,就当前错案追责制度的完善提出:明确错案认定标准、建立专门的追责机关、明确申诉时效的等几点建议。
There isnt exist a legal system which can promise all the cases have enough proofs to prove. However, the most important is how to improve and correct the wrong case. In recently, a lots of cases turned out to be misjudged, people instantly ask the judicial staff to take the aceountibility. This passage analysis the current condition of China misjudged cases liability system, including start the liability system , discover the misjudged cases, the difficulties in appeal, and how to improve this conditions.
