通过刑法的弱者保护——基于“人之图像”的学理反思

Protect the weak through criminal law: observation and rethinking base on the theory of Menschenbild

作为特定"人之图像"的弱者图像,对我国刑事立法与司法均有深远影响,向我们提出了刑法如何关注弱者的命题,但现有研究对于弱者图像的观察与预设还有待深化。特别是在步入全媒体时代的媒介化社会中,更应从多个侧面认识和呈现刑法中的弱者图像。在充分理解弱式意义上的刑法平等原则的基础上,也应当反思以弱者保护为主题的民生法治建设中可能存在的理论误区与不当做法。通过对弱者图像的刑法深描与学理反思,更应当在未来的刑事立法与司法中警惕民生刑法观的异化、汲取象征性立法的教训、避免污名化现象的出现、减少民粹式司法的影响。

As a special Menschen bild,the imagine of weak in criminal law play a very important role in the legislation and judiciary. Therefore,How to protect the weak through criminal law become more and more important even the research on the weak is still poor. In the mediated society,we should pay more attention on the issue. So this thesis will do some research on the protection of weak by criminal law. we should keep an eye on the people＇s livelihood and symbolic legislation,avoid stigmatization and also reduce medium trail.
