短期自由刑易科罚金制度浅谈

刑罚易科制度是国外在刑罚执行上采用的一种缓和硬性刑罚制度带来的不良后果的一种执行策略,通过改变刑罚的执行方式以收到最佳的执行效果。在我国当前的刑罚制度和司法实践情况下,批判地吸收易科制度的优点,有限地施行短期自由刑易科罚金制度有利于我国刑罚目的的更好实现。
