摘要
高等教育管理过程中的教育性、学术性等高等教育发展的特殊点决定了高校与学生之间的纠纷并不能全都依赖司法救济途径解决,而如果高校与学生因管理过程发生纠纷都要诉诸司法途径会导致诉讼的泛滥,从而加大法院的审案压力,因此,有必要建立和完善高校学生申诉这一非诉讼性的权利救济制度。
Higher Education Management in the process of educational,academic and other higher education determines the specific point of dispute between the university and students can not solve all rely on judicial remedies,and if the college and students who have a dispute management process access to justice will lead to the proliferation of litigation,thereby increasing pressure on the court trials,therefore,necessary to establish and improve the appeal of this non-college students the right to relief system of litigation.
