关于申请法院强制拆迁设立听证程序的探讨

2011年1月19日经过国务院常务会议审议并原则通过了《国有土地上房屋征收与补偿条例(草案)》,该草案中规定取消行政强制拆迁,由政府依法申请人民法院强制执行,因此作为非诉行政执行案件的一种,由于相关制度的不完善,申请法院强制拆迁会增加人民法院的负担,笔者认为我们亟需完善非诉执行制度,对于申请法院强制拆迁设立听证程序。
