我国突发环境事件预警制度的立法完善

预警是突发环境事件应急管理的首要环节,其功能在于有效预防突发环境事件的发生或遏制事件的发展。突发环境事件预警有效运行的关键在于:其一,根据不同突发环境事件的特征,明确预警信息发布主体,统一信息发布途径,明确预警后应急管理权限及其相关部门的法律责任;其二,在现行法中写入适用《国家突发环境事件应急预案》的准用性规则或是将该预案上升为行政法规,以保证其适用的合法性。

Early warning is the most important part of emergency management, and its function is to effectively prevent the occurrence of unexpected environmental events or to curb the development of events.
