法治能力及其方法论塑造

The Capability of Rule of Law and Methodology for Its Development

法治能力是运用综合法律素质的体现,表现为政治、经济、社会管理和日常生活决策行为的正当性、合法性。对于法治能力的研究可以从两个角度展开:一是从政治功能意义上观察,主要是研究领导干部运用法治方式(或法律手段)化解社会矛盾的能力;二是从法律功能意义上观察,主要是运用各种法律方法解决具体纷争的能力。就当下中国的法治现状来说,法学意义上的法治能力对中国法治建设有重要意义。通过法律方法的训练,可以提升人们的法律发现获取能力、理解解释能力、推理论证能力、修辞论辩能力等。在法治中国建设过程中,法治能力的形成不仅需要坚定的法治信念,更需要运用法治方式或法律方法化解矛盾、解决纠纷的能力。

The capability of rule of law reflects the overall legal quality in legal application, characterized by legitima- cy and legality of the political, economic, social management and the decision-making behavior of daily life. The study of capability of rule of law can be conducted from two perspectives., one is to observe in the sense of political function the leading cadres＇ ability to use rule of law （or law） to settle social contradictions; the other is to observe in the sense of le- gal function the use of all kinds of legal methods to solve specific disputes. Under current situation in China, the capability of rule of law in the legal sense has important significance for China＇s construction of rule of law. Legal training can en- hance people＇s abilities to discover, understand, reason, and argue legally. In the process of China＇s rule of law construc- tion, the development of the capability of rule of law not only needs a firm faith in rule of law, but also the ability to use rule of law or legal methods to settle contradictions and resolve disputes.
