摘要
本文从教育法理学视角探讨了教育惩戒权的法律特征与教育属性。教育惩戒权有教育基础,但缺乏法律依据。"教育惩戒权"的实质是"教师管理权"。教师管理学生需要适度行使教育惩戒权,但有待国家立法确权与赋权,做到有法可依、依法规制。
From the perspective of educational jurisprudence, this paper probes into the legal characteristicsand educational attributes of educational punishment. It is based on educational foundation, but lacks legal basis.Teachers need to properly use punishment for the good of students. However, the key to educational punishmentlies in the legislation on ownership and empowerment to ensure that there are laws to abide by.
