摘要
现代学徒制学徒具有学生和员工双重身份,应同时享受学生和员工双重权益,但由于我国现行法律规定、参与者法律认识缺陷及权利救济缺位等原因其双重权益并没有得到保障,解决这一问题必须通过修订法律、推行合同示范文本制及成立权益救济专门仲裁委员会来实现。
The apprentice in modem apprenticeship has the dual identity of students and employees. Accordingly they are entitled to the dual rights. Due to the deficiency in current legal provisions, participants' lack of legal awareness and the lack of equity relief, their dual rights are not guaranteed. The problem can be solved through the law revision, the implementation of the contract model and the establishment of the special arbitration com- mission for equity relief.
