社会权视阈下企业社会公益责任探析

摘要 随着社会权的持续扩张及国家立法、政策的推进,扶贫、济困的部分责任已演变为企业必须承担的法律义务。但就当下及以后较长时间而论,企业社会公益责任很大程度上仍然是道德责任。企业可以根据自己的赢利能力、发展目标及自身意愿等决定是否承担或承担多少公益责任,社会应给予充分的尊重。政府通过法律和政策促进和规制企业履行社会公益责任,仍有其必要性。 With the continuous expansion of social rights and the promotion of national legislation and policies, some of the responsibility for poverty alleviation and financial help has evolved into the legal obligation that enterprises must undertake. But in the presence and for a long time, the terms of corporate social public responsibility is still largely moral responsibility. Enterprises, based on their own profitability, development goals and their own will, can decide whether or not to bear or how much to bear public responsibility, while the community should be fully respected. It is still necessary for the government to promote and regulate the corporate social responsibility through law and policy.
