中国学位制度完善的逻辑转向——基于法律视角的思考

从法律视角分析,30多年前立法的《中华人民共和国学位条例》所规定的学位制度已不适应高等教育"大众化"和"现代化"的深刻变革,法律条文中"应然"的国家学位制度与实施过程中"实然"的大学学位制度出现了逻辑错位。应在《中华人民共和国学位条例》的基础上起草新的《中华人民共和国学位法》,从学位制度的法律属性来引导和规范学位制度的逻辑转变。

From the perspective of law, the degree system stipulated in the The Degree Regulations of People＇s Republic of China with legislation more than 30 years ago is not suitable for the profound changes in the ＂popularization＂ and ＂modernization＂ of higher education. There is a logical dislocation between the national degree system of ＂ought to＂ in law and the university degree system of ＂actual＂ in the process of implementation. Therefore, The People＇ s Republic of China Degree Law should be drafted on the basis of The Degree Regulations of People＇s Republic of China to guide and standardize the logical transformation of the degree system from the legal attribute of the degree system.
