Information Processing Strategies and Persuasion Effects Thereof in Chinese Court Conciliation Discourse

在法院调解过程中,法官如何通过有效的信息处理方式说服当事人改变态度、达成合意是备受关注的一个课题。结合"深加工可能性说服模式"(ELM),分析法院调解中法官如何通过信息内容选择、信息组合方式、信息呈现风格等语篇信息处理方式使当事人有动力、有能力通过中心路径深入加工信息,并通过认知努力将信息有机融合到已有的认知结构中,实现改变当事人认识、态度、行为的说服效果。

During court conciliation （CC）, it has been a heatedly discussed issue how judges employ effective information processing strategies to help parties change attitudes and reach settlements.This paper applies the Elaboration Likelihood Model of Persuasion （ELM） to analyze how judges in CC resort to various information processing strategies to motivate and enable parties to elaborate on information from the central route to persuasion and integrate the information into their existing cognitive structure.Data analysis shows that the strategies used by judges include the selection of information contents, ways of information combination and styles of information presentation.Through these strategies of information processing, judges may achieve the intended persuasion effects, including the change of parties beliefs, attitudes and behaviors.
