Thoughts on the Construction of Fair Competition Review Mechanism

2016年6月1日,国务院公布了《关于在市场体系建设中建立公平竞争审查制度的意见》(以下简称《意见》),提出在市场竞争体系中建立公平竞争审查机制。指出建立公平竞争审查制度的重要性和紧迫性,明确了建立公平竞争审查制度的总体要求和基本原则,并提出科学建立公平竞争审查制度,推动公平竞争审查制度的有序实施,健全公平竞争审查保障措施。但是,鉴于配套法律法规与实施机制的缺失,我国在建立健全公平竞争审查机制上仍面临着诸多问题。通过对公平竞争审查制度进行溯源性思考,明晰公平竞争审查制度建立的基础条件,借鉴欧盟、新加坡以及韩国等国家有益的经验,提出我国建立公平竞争审查制度的框架性思考。

On June 1, 2016, the State Council promulgated the Opinions on the Establishment of Fair Competition Review Mechanism in the Market System ＂ （hereinafter referred to as the ＂opinions＂）, clearly put forward the establishment of fair competition review mechanism in the market system, pointed out the importance and urgency of establishing the mechanism, defined the overall requirements and basic principles of the mechanism, and proposed to scientifically establish the mechanism, promote the orderly implementation of the mechanism, and improve the security measures for the mechanism. However, China still faces many problems in establishing and perfecting the mechanism due to lacking of supporting laws, regulations and implementation mechanism. This paper proposed a framework on the establishment of fair competition review mechanism in China by tracing the development of the mechanism, clarifying the basic conditions to establish the mechanism, learning experience from Singapore, the European Union, South Korea and other countries.
