银行外汇领域原则监管与规则监管有效结合研究

The Research on the Effective Combination of Principle-based Regulation Mode and Rule-based Regulation Mode in Banks'Foreign Exchange Field

金融危机爆发之后,原则性监管方式日益受到监管机构的重视,并且在多国金融监管中实践。我国外汇管理按照"五个转变"的改革理念,自2012年开始引入"展业三原则",体现了原则性监管要求。本文基于原则性监管国际经验,剖析原则性监管在我国的实践及存在的不足,围绕树立监管理念、确立监管原则、重塑组织架构、完善管理手段等关键着力点,探索构建我国银行外汇领域原则监管与规则监管相结合的有效监管模式。

After the outbreak of the financial crisis, principle-based regulation has been paid attention to by regulators, and has been in the practice of multinational financial supervision. In accordance with the reform idea of ＂five changes＂, ＂Three Principles of the Development of Banks＇ Business＂ has been introduced in China＇ s foreign exchange administration since 2012, and reflects the requirements of the principle-based regulation. The paper analyzes the practices and existing disadvantages of principle-based regula- tion in China according to the international experiences of principle-based regulation. And then, around the key points such as estab- lishing supervision ideas, setting up regulation principles, reshaping organization structure and improving management methods and so on, the paper explores to construct an effective supervision mode combined principle-based regulation with rule-based regulation in China＇ s foreign exchange field.
