A Review of German Custom Law and Legal Scholars in China

德国法学家在习惯与法的关系的论证上强调法律起源与习惯的关系在于法律源自习惯。在法律的应用上,德国法学家认为习惯对于司法而言具有一定的推动作用,但习惯的应用是建立在尊重现有法律的前提下的,同时对我国法律学者对德国习惯法做一简要评述。

The relationship between the German jurists in the demonstration of the custom and the law on the origin and custom law is law from habit.
