The Origin and Development of Complaint Letter and Request Handling System

我国的信访制度既不是自古就有的,也不是从古代的直诉制度转化而来。信访思想渊源于马克思主义群众观,滥觞于巴黎公社时期的监督制度,列宁将其初步制度化,毛泽东在吸纳列宁信访理论的基础上,进一步创新和发展,使信访制度逐步演化到今日之样态。人民主权学说则是其合法性理论基础。因而信访就是作为主权者的人民实现其监督国家机关权利的一种形式。

The thought about complaint letters and requests originates from Marxist mass view and the supervision system of the Paris commune period. Lenin has made it preliminary institutionalized. On the basis of Lenin＇s theory, Mao Zedong has further innovated and developed complaint letter and request handling system, which gradually evolved into today＇s status. The people＇s sovereignty theory is its legitimacy foundation. Therefore, complaint letter and request handling is a form for the people supervising the state organs as sovereigns.
