检察机关监督社区矫正的实践、问题和对策——以N市检察机关社区矫正监督工作为样本

The Practice,Problems and Countermeasures of Community Correction Supervision by Procuratorial Organs:Taking N city as a Sample

从2003年试行社区矫正工作以来,N市检察机关结合江苏省刑事执行检察工作平台,采取书面审查、实地调查以及电子核查的方法对全市社区矫正工作开展了有效的监督。监督实践发现社区矫正工作存在工作队伍薄弱、拟适用社区矫正调查评估问题多、交付执行乱、矫正和教育管理虚化、收监执行标准模糊等问题。而检察监督也面临缺少操作规范、监督信息获取难、监督缺乏刚性、监督协作机制不全和监督队伍不适应监督工作需要等难题。可以从制定社区矫正法、配套出台社区矫正检察工作办法、建立全国社区矫正信息平台、构建社区矫正一体化监督机制和强化社区矫正检察队伍等几个方面着力完善社区矫正及其监督。

Community correction program has been put into trial use in N city since 2003. From then on, the procuratorial organs has conducted effective community correction supervision in the realm of whole city in the form of document investigation, on site investigation and electronic investigation on the criminal prosecution procuratorial work platform in Jiangsu province. The supervision indicates that there are something needs to be improved, such as shortage of experienced community correction staff, various problematic proposed community correction programs, chaotic management of enforcement and correction, no transparent criteria and so on. Supervision also faces shortage of standardized correction norms and consistency, inaccessible to supervising information, and lack of supervision officers. The author proposes that adjusting the current program should begin with enacting an appropriate community correction regulation, and guidance of appropriate supervision work. Information platform for community correction is also quite necessary. It is also quite urgent to cultivate experienced community correction officers.
