少数民族地区司法困境启示——基于《马背上的法庭》的叙事

The Revelation of Judicial Dilemma in Minority Areas——Based on Courthouse on Horseback in the Perspective of Sociology

习惯与法律之博弈由来已久,在学界的讨论也是方兴未艾,大多学者都从法律科学的形成及其体制性来论述。然而,对于习惯与法律之间,不应该局限于此,应该从更广阔的社会学视野去审视。《马背上的法庭》这部影片,从文学角度生动地刻画出了当下中国少数民族传统习惯与国家法律之间的割裂,一系列案列的审判过程,凸显了乡民们对于习惯的坚守和对于国家法律的无知、无畏,一次次的展示出民族地区传统习惯与国家层面的法律规范的灰色幽默。故,要破解二者之间的隔阂,先要辨明其缘由,就是差序格局下的中国社会,国家法律与民间传统习惯还存在着二元格局,影片给出的启示就是要二者互相交融,方可和谐互利,这也是我国一体多元的社会构架之内涵。

The game between custom and law has a long history,so it is in the academic circles as well,where a majority of scholars have discussed them form the perspective of the formation of legal science and its system. However,the discussion about custom and law should not be limited to this,it should be surveyed from the broader sociological perspective. The film of Courthouse on Horseback depicts vividly the current split between the Chinese minority traditional custom and state law from the perspective of literature,in which,with a series of case trial,it highlights the villagers’ persistence in the traditional custom and their ignorance and fearless to the state laws,and it also show out repeatly the black humor in the ethnic custom and the law regulations of national level. The reason that makes the barrier between them is the sequence pattern of Chinese society,in which national law and folk customs still exist dualistic structure. To crack the barrier between them,the film supply us with the enlightenment that is to blend them with each other,and make mutual harmony,which is our country’s connotation of a pluralistic social framework.
