摘要
京津冀跨区环境纠纷产生的原因多种多样,存在着显性和隐性纠纷之别,现行跨区纠纷化解的法制供给只针对有限的显性纠纷且存在诸多不足,而针对隐性纠纷的制度化化解机制阙如。在实施京津冀协同发展战略的背景下,结合三地实际情况以及现行法律框架的基础上,采取有力措施建立健全适用于京津冀三地跨区显性环境纠纷解决的法律机制,同时应建立相关的制度性跨区利益协调机制为化解那些跨区隐性环境纠纷提供保障。
The cross-regional environmental disputes in Beijing, Tianjin and Hebei are caused by a variety of reasons and differ in explicit and implicit types. Currently, the legal resolution supply is only limited to some explicit disputes and also has many defects, whereas the institutionalized cross-regional interests coordinating mechanism for resolving the implicit disputes is still missing. In the background of implementing Beijing-Tianjin-Hebei collaborative development strategy, basing on the actual situations of the three administrative areas as well as the current law framework, the powerful measures should be taken to perfect the legal resolution mechanisms focusing on the explicit disputes in Beijing, Tianjin and Hebei, and meanwhile an institutionalized cross-regional interests coordinating system should be established to provide assurances for resolving those cross-regional implicit environmental disputes.
