涉外缔结婚姻法律适用问题研究

Study on the Legal Application Issues of Foreign Marriage Registration

婚姻家庭是社会生活的组成部分,对维护社会稳定至关重要。经济全球化的迅速发展,深化了世界各国之间的交流联系,涉外婚姻也呈上升趋势。由于各国文化和婚姻法律制度存在差异,涉外婚姻的法律冲突也就在所难免。通过分析中国涉外婚姻的法律冲突及法律适用中存在的问题,提出相应完善建议,期望能够预防和避免"跛脚婚姻",实现世界范围内婚姻家庭法律制度的协调统一。

Marriage and family is an integral part of social life, which is very important to maintain social stability. With the rapid development of economic globalization, the close relationship between the countries all over the world is increasing, so is the foreign marriage. Due to the differences in the cultural and legal systems of different countries, the conflict of laws concerning foreign marriage is inevitable. Based on the analysis of the existing conflict of laws and the problems of legal application of foreign marriage, this paper puts forward relevant suggestions, hoping to prevent and avoid ＂lame marriage＂, and achieve the harmonization of marriage and family legal systems throughout the world.
