摘要
当前,我国草原生态系统正处于严重恶化之中。综观各种原因,以草原为主要生产基础的企业在传统人类中心主义理念驱使下,为追求经济效益最大化对草原生态资源掠夺式的开发利用是草原生态环境遭遇破坏的主要原因之一。从我国草原立法保护现状来看,单靠行政、民事及其他社会保障手段已不足以遏制企业对草原生态环境的破坏行为,更于草原生态的恢复效果甚微。刑法的介入对草原生态的保护而言意义重大。针对企业行为对草原生态环境的破坏,刑法介入最合理的方式就是在提升草原生态法益保护理念的基础上完善企业相关刑事责任的规定,进而有效遏制企业破坏草原生态的犯罪行为。具体而言,我国企业在此方面刑事责任的完善应体现在归责原则的重置、刑罚种类的增加与量刑幅度的提升等几方面。
At present, China' s grassland ecosystem is in serious deterioration. A variety of reasons, depending on the grassland resources enterprises in the traditional concept of human center doctrine driven by the pursuit of maximum economic benefits the development and utilization of grassland resources plunder is the main reason of grassland ecological environment destruction. According to the present situation of our country' s legislation protection of grassland, the administrative, civil and other social security measures are not enough to contain the destructive be- havior of the enterprises to the grassland ecological environment, but also to the restoration of grassland ecosystem. The intervention of criminal law is of great significance to the protection of grassland ecology. In view of the enterprise acts of destruction of the ecological environment of grassland, provisions of the criminal law intervention the most rea- sonable way is to improve the enterprise related criminal responsibility based on enhancing grassland ecological pro- tection of legal interests on the idea, and effectively curb the criminal damage to grassland ecological enterprises. Specifically, China' s enterprises in this regard, the improvement of criminal responsibility should be reflected in the replacement of the principle of imputation, the increase in the type of punishment and the extent of the increase in the number of sentencing, and other aspects.
