我国《民法总则》规定消费者概念的重要价值

The Important Value of Provision of the Concept of Consumer in General Principles Part of the Civil Code of China

我国《民法总则》第128条规定的民法特别法链接条款,将消费者保护法纳入了我国民法特别法体系,实现了消费者保护法与民法一体化的目的。这一规定既是我国《民法通则》的立法传统,也借鉴了《德国民法典》消费者概念一体化的经验,具有特别重要的立法价值。我国《民法总则》将消费者保护法纳入民法典体系,明确消费者保护法的基本性质属于私法,确定消费者保护法是民法特别法,消费者保护法规定的私法规范受《民法总则》规定的基本规则的规制,消费者保护法规定的私法规范具有优先适用的效力。

The Article 129 of General Principles Part of Civil Code provides the linkageprovi- sion for special law of civil law, which incorporates Consumer Rights and Interests Protection Law into the system of special law of civil law, and has realized the purpose to integrate Consumer Rights and Interests Protection Law and civil law. This provision is not only the legislative tradi- tion of General Principles of Civil Law in China, but also learns from the experience of the inte- gration of the concept of consumer inthe German Civil Code, thus it＇ s particularly valuable in legislation. General Principles Part of Civil Code in China incorporates theConsumer Rights and Interests Protection Law into the system of civil law, clears thatthe basic nature of Consumer Rights and Interests Protection Law is private law, and determines that Consumer Rights and In- terests Protection Law is the special law of civil law. Its privatelaw rules, regulated by the basic rules of General Principles Part of Civil Code, havepriority of application.
