马锡五审判方式是陕甘宁边区这一特殊历史环境下的产物,以其坚持一切从实际出发、认真贯彻群众路线、坚持党性原则、实行灵活利民的诉讼手续等为世人称赞,其蕴含"司法为民、司法公正、司法民主"的法治价值,不仅集中体现陕甘宁边区优秀司法传统、承继创新古代中国数千年司法智慧,也契合变革时代中国社会的特殊需求。陕西富县法院、江苏陈燕萍法官都是新时期传承马锡五审判方式的典型。在全面推进依法治国新形势下,传承和发扬马锡五审判方式所蕴含的基本法治价值,仍有巨大的现实意义。
