论低致命武器在海上执法中的合理使用——以两起韩国海警使用低致命武器致我渔民死亡案例为视角

Rational Use of Less Lethal Weapons in Maritime Law Enforcement——Lessons from Two Incidents of Chinese Fisherman's Death

橡皮弹与爆音弹等警用装备已被广泛用于警察执法并在行动中有良好表现,但也发生了一些严重伤害人体乃至造成死亡的恶性事件。近年发生的两起韩国海警使用橡皮弹和爆音弹致我渔民死亡案例就是明证。对橡皮弹及爆音弹战术技术性能数据的分析表明,两者皆属于低致命武器,因此其执法使用需慎之又慎且需符合安全使用规定。韩国海警违反低致命武器战术使用安全常规是造成渔民死亡的重要原因,其不专业的执法表现涉嫌过度使用武力。鉴于我国主张管辖海域具有显著的"争议海域"特征,我海警应从两案中吸取教训并采取有效措施以便合理、合法使用执法武力。

Rubber and sonic boom bullets have been widely used in law enforcement. Although it has good performance in operation, it can also cause some serious injuries to the human body and even death. Cases in point are the two incidents of Chinese fishermen＇ s death caused by South Korean Coast Guard who violated the rules for safe use of rubber and sonic boom bullets. The analysis of the tactical technical performance data of rubber and sonic boom bullets shows that both of them are less lethal weapon, so the use of them in law enforcement should comply with safety rules. In the two incidents of Chinese fishermen＇ s death, the excessive use of force by South Korean Coast Guard shows their non - professionalism in law enforcement. In view of disputes over the maritime areas claimed by China, our coast guard should learn from their lessons and take effective measures to use force reasonably and lawfully.
