《封诊式》中隐名代词“乙”的考察分析

An Investigation and Analysis of the Anonymous Pronoun “Yi” in “Feng Zhen Shi”

选取《封诊式》中的隐名代词"乙"作为研究对象,采用文献研究法和比较研究法,归纳隐名代词"乙"在《封诊式》中的特殊用法,即《封诊式》并非按照天干顺序依次使用隐名代词,突出表现在刻意略过"乙",使用"甲""丙",且在使用隐名代词"乙"时,基本不指代犯罪方。对于这一特殊用法的使用原因,从内因和外因两个角度进行探究,推测这可能是秦诉讼判词的特殊格式。

In this paper, the anonymous pronoun “Yi” in the “Feng Zhen Shi” was chosen as the research object, using the liter-ature research method and the comparative study method to summarize the special usage of the anonymous pronoun “Yi” in “Feng Zhen Shi”. The anonymous pronoun “Yi” is rarely used while using “Jia” and “Bing”, and ＂Yi＂ basically does not refer to the guilty parties. As for the reason of this special usage, the internal and external factors were explored in the article, then an as-sumption was made that it may be the special format of Qin＇s litigation document.
