Combination of Human Dignity and Personal Information Protection

当今时代,人格越来越多地表现为数字或符号,这些能够识别个体特征的数字和符号,常常被称为个人信息或个人隐私。各国政府立法保护个人信息的目的,就是要让作为社会主体的人们的个体尊严得到尊重,以此来维护社会的和谐与稳定,从而有利于社会经济的发展。从现实需要出发,根据国际国内的相关立法规定,借用学者理论观点,进一步厘清人格尊严、个人隐私、个人信息的内涵和相互关系,确立尊重人格尊严、立法保护个人信息制度,不仅是我国法治建设必不可少的组成部分,而且对维护社会安定、构建和谐社会具有现实意义。

Nowadays personality is increasingly represented by numbers or symbols. These numbers or symbols can identify the individual characteristics which often being referred to as personal information or personal privacy. Being the social subject, the purpose of legislation is to protect the individual dignity, so as to maintain the harmony and stability of the society, which is conducive to the development of society and economy. It is necessary to establish a system of respecting human dignity and legislation to protect personal information in accordance with the relevant iuternational and domestic legislative provisions. By borrowing scholars＇ theoretical perspectives to strength the cnnnotation and mutual relations of personal dignity, the legislation can further develop personal privacy and personal information. This is not only the essential part of the legal construction in China, but also has the practical significance to maintain the social stability as well as construct the harmonious society.
