审查起诉听证机制运行现状实证研究

审查起诉听证有利于案件的公正处理,有利于审查起诉程序正当性的完善,有利于进一步深化检务公开。近年来,各地检察机关对审查起诉听证机制进行了有益探索,并取得了一定的成效。但是,该机制在运行过程中仍然存在许多问题,如功能定位存在偏差,适用案件范围过于狭窄,启动程序不完善,裁决主体的认识错位。对此,应当准确定位审查起诉听证机制的功能,适当扩大适用案件范围,完善启动程序,取消听证团和听证组的设置,科学设置听证流程。
