论我国土壤污染防治基金制度的构建--以我国台湾地区土壤及地下水污染整治基金制度为鉴

On the construction of soil pollution prevention fund system in China

我国现有土壤防治资金相关制度规范体系庞杂且层次较低、制度规定内容分散且范围较窄,不能为土壤环境保护的资金来源提供应有的制度保障。而我国台湾地区建立了专门的土壤及地下水污染整治基金及配套性的制度,取得了良好的实施效果。在我国台湾地区已有经验的基础上,应在《土壤污染防治法》中对土壤污染防治专项基金予以规定,明确基金的性质与目的,并通过配套性制度的建立,对基金的管理、收支、运行等内容予以明确规定。

The regulatory system of soil pollution prevention in China is relatively complex, scattered, narrow and low level which can~ t provide the necessary institutional protection for the fund source of the soil environmental protection. China＇s Taiwan Region has established a special soil and groundwater pollution remediation fund and supporting system, and achieved good results. Based on the experience of Taiwan as reference, the Soil Pollution Control Law should regulate the special fund of soil pollution protection remediation by clarifying its property and purpose. The management, revenue and expenditure and operation should be regulated by established matching system.
