论政府建设工程项目浪费的法律规制

我国现行法律制度在规制政府建设工程项目浪费方面存在法律缺失、违法成本低、处罚不力、社会监督机制形同虚设、政府信息公开制度不完善等问题。建议填补针对政府建设工程项目浪费的立法;完善社会公益诉讼制度,将政府建设工程项目浪费行为纳入公益诉讼范围;建立领导干部和相关责任人员终身追责制,提高违法成本;借鉴国外经验,完善社会监督机制,将社会监督法制化、规范化和具体化;完善政府信息公开制度,扩大信息公开范围,细化信息内容,提高信息质量。
