教育行政执法联动协作机制研究

在教育行政执法实践中,一些教育违法行为往往是涉及多个行政部门,单靠一个部门执法效果有限,难以起到应有的威慑力,各有关行政机关之间应该建立起有效的教育行政执法联动协作机制。在充分调研的基础上,通过深刻分析建立教育行政执法联动协作机制的意义、目前存在的主要问题,提出相应的对策建议,即尽快完善支持教育行政执法联动协作机制的法律法规,建立高级别、权威性的教育行政执法联合执法协调机构,在联席会议框架下成立联合执法组建立快速响应机制,建立部门间联合执法的信息联络共享机制等。

In the practice of administrative enforcement of law in education, some illegal acts are often involved with many administrative departments. The law enforcement from a single department is limited. It is difficult to play the due deterrent. The relevant administrative organs should establish an effective linkage collaboration mechanism of educational administration and law enforcement. On the basis of full investigation, in this paper the significance of the linkage collaboration mechanism of educational administration and law enforcement is analyzed, and the problems, countermeasures and suggestions are put forward. First of all, we should improve the laws and regulations supporting the linkage collaboration mechanism of educational administration and law enforcement as soon as possi- ble. Secondly, we should establish a coordinating organization with high level and authority for the linkage collaboration mechanism. Thirdly, we should set up a joint law enforcement team in the framework of the joint meeting, and establish a lish the information sharing mechanism of ioint rapid response mechanism. Finally, we should estab- law enforcement among departments.
