社区矫正官执法身份和执法主体资格缺失,严重阻碍了当前社区矫正工作的顺利进行。社区矫正官执法身份缺失的缘由,立法忽视是一方面,但更主要应归因于社区矫正队伍建设的结构性缺陷。社区矫正的性质如果界定为刑罚执行,那么赋予社区矫正官人民警察的执法身份就是必须的,但只有司法实务部门建成专业、统一、稳定、符合刑罚执行素质要求的执行机构和矫正官队伍,执法身份和执法主体资格的赋予才能有所依傍并避免造成警种混乱。

The deficiency of community correction officer as law enforcement agency is seriously hampering community correction from moving forward. The reason for this lies not just in the deficiency of legislation, but also in the structural defects of community correction team. If community correction is defined as the execution of legal punishment, then the community correction officer is necessarily entitled to the same identity as the police. However, only when judicial departments set up professional, unified, and stable executive agencies and teams, can the quality requirements of legal punishment be clearly met. Only thus, can the community correction officer be entrusted with law enforcement identity while avoiding chaos of police classification.
