从证据效力角度浅析环境监测报告存在的问题及对策

Analysis on the Problems and Countermeasures of Environmental Monitoring Report from the Perspective of Evidence Effectiveness

随着"两高司法解释"和新环保法的施行,涉刑环境案件激增,对环境监测报告的证据效力提出了更高的要求。本文从证据效力客观性、关联性和合法性等"三性"的角度,分析了影响环境监测报告证据效力的因素,并给出相应的对策建议。

With the implementation of two supreme judicial interpretations and the new Environmental Protection Law, there is an increasing trend in environmental criminal cases. This puts forward higher requirements in the evidence effectiveness of environmental monitoring report. This paper analyzed the factors influencing the evidence effectiveness of environmental monitoring report from objectivity, relevance and legitimacy, and given the corresponding countermeasures and suggestions.
