总体国家安全观指导下公共安全情报法律体系构建研究

Study on the Construction of Public Security Intelligence Legal System in the Guidance of Holistic View of National Security

[目的/意义]研究总体国家安全观视角下公共安全情报法律体系的调整对象、基本框架和实现路径,对完善公共安全情报法律体系具有重要意义。[方法/过程]从两个角度梳理了公共安全情报的涵义,提出了总体国家安全观视角下公共安全情报的理解,反思了公共安全情报法律体系建设中存在的不足,从理论层面论述了总体国家安全观视角下公共安全情报法律体系的优化。[结果/结论]总体国家安全观视角下公共安全情报法律体系的优化,一是要在《国家安全法》的框架下设计,二是要树立国家安全与人权保护相统一的价值导向,三是要树立国际视野,四是要形成新的公共安全情报法律体系框架。

[ Purpose/Significance] It is of important significance for the construction of public security intelligence law system to study the adjustment object, basic framework and realizing method of public security intelligence legal system from the perspective of holistic view of national security. [ Method/Process] This paper explains the connotation of public security intelligence from two angles, proposes the understanding of public security intelligence from the perspective of holistic view of national security, reflects the construction short- comings of the legal system of public security information, and discusses the legal system＇s optimization from the perspective of the overall national security concept. [ Result/Conclusion] The optimization of public security information law system from the perspective of overall national security includes 4 aspects： first, designing under the framework of ＂National Security Law＂ ; second, establishing the value ori- entation of the unity of national security and human rights protection; third, establishing an international perspective; forth, forming a new legal framework for public security intelligence.
