摘要
公证制度在我国十年间取得了长足的发展,其出具证明、解决纠纷、服务经济的能力得到不断增强。与之相比,公证在不动产物权流转领域的发展却较为缓慢。其现状纵然有些令人遗憾,但公证制度在我国不动产流转领域依然大有可为。尤其在不动产统一确权登记制度的背景下,公证介入不动产物权流转比以往任何时候都具有正当性与合理性。交易安全、不动产物权流转及其统一交易市场的构建、市场主体信用建设、私权的充分尊重等都需要公证发挥其应有的作用,其"保驾护航"功能不可漠视。
Our country has witnessed significant progress in notary system in the past decade, and its capabilities of issuing a certificate, resolving disputes and serving economy has been constantly strength-ened, nevertheless, not in the field of real estate property rights transfer as well. Based on the real estate unified approval registration system, notarization's involvement in real estate property rights transfer be-comes more legitimate and reasonable than ever before. The notary system can also play important roles in transaction security, the real estate property rights transfer,the establishment of a unified market, con-struction of credit in main market players and fall respect of privacy .Thus, its functions of guidance and regulation cannot be ignored.
