摘要
随着消费者健康意识的增长,营养类食品的种类不断增多,但也因为成分新颖或者信息缺失而存在安全隐患。有鉴于此,政府对食品营养的干预已经采取了多种法律形式,如营养改善与营养标识立法,特殊营养食品的从严监管。然而,这些立法的方式是以问题为导向,且内容上也碎片化。鉴于营养性疾病的日益严峻,有必要对营养规制的方式和现有法律进行梳理,进而构建有序且协调一致的规制体系,以实现营养安全基础上的公众健康。
With the increasing health consciousness of consumers, more and more food categories for nutritional purposes have been put into market while the health risks may be caused by the novel substances or lack of labeling. Therefore, many different legal forms have been undertaken during the government intervention, such as the legislations regarding nutrition improvement and nutrition labeling as well as the strict regulation of food with special nutritional needs. However, the legislations in this aspect have been shaped in ad-hoc way while characterized by fragmentation. Given the consideration of the rising nutritional diseases, it is necessary to examine the current instruments for nutrition intervention, with the purpose of integrating them into a coordinated regulatory system and protecting public health through food safety assurance from the perspective of nutrition.
