On the Dilemma and Solution of the Necessity Censorship of Detention

本文通过对广德县近三年办理羁押必要性审查案件的分析,引申至执检部门办理羁押必要性审查的困境,试着从发挥驻所检察优势、整合信息获取渠道、提高案件办理质量、深化延伸案件办理领域来探索当前环境下羁押必要性审查的出路,从而履行检察机关践行法律监督,维护人权保障和司法公正的职能。

Based on an analysis of the cases concerning the ne- cessity censorship of detention in recent three years in Guangde County, this paper puts forward the dilemma of inspection de- partments in handling cases concerning the necessity censorship of detention, trying to explore the solution of the necessity cen- sorship of detention in the current environment from giving play to the advantages of prosecutors, integrating the access to infor- mation, improving the quality of case handling, and extending the field of case handling. The aim is to help procuratorial organs to fulfill the function of practicing legal supervision and maintaining human rights protection and judicial justice.
