摘要
近年来,公平、合理、无歧视许可承诺(FRAND承诺)已成为标准化组织所采取的普遍政策,这不但能鼓励技术创新,而且还能促进市场经济的发展。可是由于FRAND原则本身所具的抽象性等特征,承诺的性质、效力等问题在理论研究和实践操作中仍存在较大争议。本文通过对标准化组织FRAND政策的分析比较,以此为基础界定专利权人的FRAND承诺性质,并对专利权人、标准组织与标准实施者的权利进行规制,以协调各方的利益,促进科技进步和经济发展。
FRAND commitment （Fair, reasonable and non-discriminatory licensing commitment） has become a common policy which is taken by the standardization organization. However, there are also some ambiguities in the theory research and practice operation. Comparing with the relevant provisions of different organizations, we analyzed and learned the nature of FRAND commitment. It＇s an offer of contract which is compulsory. Therefore, to admit that the commitment has legal effect to the necessary patentees and standard implementers is the basis to balance the interests among them.
