食品安全事故中疾控机构卫生处理职责探讨

Duties of CDC in handling food safety incidents

文章针对新修订的《食品安全法》中关于疾控机构在食品安全事故处置中的卫生处理职责进行了探讨,认为与监管部门、肇事者相应职责及义务的区分和衔接没有明确,由此可能给疾控机构及工作人员正确履职带来困惑和极大风险。进而通过对我国以往食品安全事故卫生处理的内容和范围回顾,借鉴世界卫生组织(WHO)相关指南,提出食品安全事故卫生处理的概念和范围。并从卫生处理行为各主体法律属性分析得出疾控机构是相应行政法律关系中的一类特殊的行政主体,其行使的现场卫生处理职责既不是相关的行政控制措施,也不是代替肇事者负有义务实施的具体行为,而应是根据流行病学调查情况向监管部门和相关责任单位等提出的卫生处理措施的建议及意见。

This article discusses the duties of CDC in handling food safety incidents aiming at the new revision of the Food Safety Law. think with regulators, perpetrators corresponding responsibility and obligation to distinguish and co- hesion is not clearly, thus may brings to the CDC and the staff started right confusion and great risk. And past health of food safety accidents in China the content and scope of review, learning from the world health organization（WHO） guidelines,puts forward the concept of health food safety accident treatment and scope. And from all the main legal at- tribute of sanitization behavior analysis CDC is a special kind of administration in administrative legal relations corre- sponding main body,the exercise of the sanitization responsibility is not related to administrative control measures,is not to replace the perpetrators have responsibilities to implement the specific behavior,and should be according to the epidemiological investigation to the regulatory authorities and relevant responsible units such as health treatment meas- ures are put forward Suggestions and opinions.
