Cease and desist letter（the ＂CD letter＂） is the most frequently used self-help remedy by the patentee to protect its patent right in business transactions. The content and delivery of a CD letter shall be governed by the General Principles of the Civil Law and the Anti-Unfair Competition Law in China. Therefore, a patentee shall evaluate the effect and the risk of a CD letter before drafting and sending out the letter.
