摘要
本文根据专利审查指南中创造性的"三步法"判断方式,结合处理审查意见过程中的具体体会,对如何分析现有技术是否给出了转用发明的技术启示进行讨论。在此基础上,以一个具体案例作为示例,对讨论得出的技术启示分析方式进行适用,以期为转用发明的创造性评价和答复提供可行的思路。
This article discusses how to analyze whether prior art provides technical teaching to the invention by diversion according to the inventiveness judgment modes of "three-step approach" from Guidelines for Examination and concrete experience from processing office actions. Based on this, the technical teaching analysis mode by discussion is applied to a case as an example, so that it is proved to be a practicable mode for determining or reply inventiveness.
