浅析国际申请进入国家阶段时“援引加入”的注意事项

A Brief Analysis of Something to Pay Attention to in “Incorporation by Reference” When International Application Entering the National Phase

本文就按照专利合作条约(PCT)提出的国际申请进入国家阶段时援引加入内容的确定、援引加入事项的填写及援引加入事项的审查,结合案例进行了总结,对于申请人提交文件的易错点进行了说明和提示。对于"关于援引加入的说明"与国际局传送的"确认援引项目或部分决定的通知书"(PCT/RO/114表,以下简称"RO114表")记载的不一致、援引加入文件的性质这两种特殊情形,笔者通过对具体案例的分析和思考,探讨了问题出现的原因,并对几种可能的解决思路进行了评析,提出了合理可行的解决方法及建议,即:"关于援引加入的说明"应与国际局传送的RO114表记载的信息一致;"援引加入"文件的性质等同于申请文件。

When confirming, writing and examining items of Incorporation by Reference in processing of international application entering the national phase according the Patent Cooperation Treaty （hereinafter called ＂the PCT＂）, fallibilities in documents submitted by a proposer are described and prompted in this paper combined with summarized cases. In two special situations, the authors discussed causes, analyzed several possible solutions and proposed reasonable and feasible suggestions, that is, ＂Illustration about Incorporation by Reference＂ should be in accord with ＂Notification on Decision of Confirmation of Incorporation by Reference of Element or Part＂ delivered by The International Bureau （Table form PCT/ RO/114）, and the nature of ＂Incorporation by Reference＂ of elements or parts should be equal to application documents.
