关于专利法实施细则第40条在审查实践中一些问题的探讨

专利法实施细则第40条在审查实践中情形比较复杂,存在处理标准不统一现象。本文阐述了对该法条的理解,并探讨了申请文件附图关联交错及电子申请中文件类型提交错误等情形适用该法条时的处理方式,还对该法条执行过程中的一些例外情形的处理方式进行了探讨,并就同样的发明创造的同日发明和实用新型专利申请涉及该法条时应注意的事项给出了建议。

Rule 40th is more complex in practice, standards are not unified. This paper expounds the understanding of law article, and discuss the process way when the application documents appended drawings having correlation errors and the file type of the electronic application having submitted errors, also discusses the enforcement for some exceptions,and this paper also points out some matters that should be paid attention to when dealing with patent and utility model applications relating to the identical invention-creation, on the same day.
