儒家文化与中国的法律传统

Confucian Culture and Chinese Legal Tradition

文章分别从儒家语言、儒家的人性论、儒家的核心价值观等视阈研究儒家文化对中国法律传统的影响,认为中国的法律传统存在礼法合治、重公法轻私法、重义务轻个人权利等特点,提出中国立法一方面要对中国优秀的法律传统进行继受,另一方面又要认识到中国法律传统中重公法轻私法、重义务轻个人权利,忽视对个人财产权的尊重等内在缺陷,吸收西方国家重视个人权利、私法以及尊重财产权等现代法治理念,从而在我国建立现代法律体系,实现向现代法治国家转型。

A respective research of the influence of Confucian culture on Chinese traditional laws is made from the Confucian language, Confucian theory of human nature, the core of Confueian values in this article. We can come to the conclusion that a meantime government by rites of zhou and laws, more public laws- less private laws, heavey duty and light-rights existed in Chinese traditional laws, and it is pointed out in this article that the Chinese excellent legal tradition should be inherited on the one hand, the internal de- fects of more public laws-less private laws, heavey duty-light-rights and disregarding of individual proverty rights should be acknowl- edged on the other hand.Meanwhile, we should absorb modern concept of legal government of western countries attaching great impor- tance to the personal rights, private law and respect for property rights and set up the modern legal system in our country, and finally re- alize the transformation to modern countries under the rule of law.
