违法行政行为的处理方式有确认无效(违法)、撤销、追认、补正、转换、判决在一定期限内履行义务或重作行政行为、承担赔偿责任等。在处理具体的违法行政行为时,既要考虑是否有利于公共利益的维护,又要兼及相对人信赖利益的保护;既要考虑是否符合依法行政原则的基本要求,又要注重行政效率的提高和已有行政法律关系的稳定。除此之外,还应结合行政行为违法的不同类型作具体分析,以行政行为共同具有的一般有效要件为标准,违法行政行为可分为管辖权违法、形式违法、程序违法和内容违法,违法行政行为应当依据行政违法的不同类型分别处理。
