摘要
建立城乡统一的建设用地市场已成为共识,然而分割的市场也存在正效应。本文通过城乡建设用地市场"分割效应"和"融合关键"的辩证思考提出完善城乡建设用地市场的"统一路径",认为统一市场构建要以维持正效应和减少负效应为原则,避免产生新问题。因而,要建立城乡统一的建设用地市场,一方面要继续保持市场分割条件下促进乡村经济发展和弥补各级地方政府财政收入的正效应,另一方面要从法律上明确城乡建设用地同地同权同价待遇、实践上明确统一市场交易平台的主体责任、健全凭证管地用地制度和协调征地与集体建设用地流转收益冲突,减少融合后的负效应。
Although constructing a unification market of urban-rural construction land has been well accepted,the division market of urban-rural construction land has still some positive effect on social economic development.Dialectical view was employed in this paper to analyze the effect of division and the key points of amalgamation in order to improve the unification path to urban-rural construction land market.This paper argued that the principle of constructing a unification market of urban-rural construction land should be to increase positive effect and reduce negative effect,and avoid giving rise to new problems.Firstly,the positive effect of promoting rural economy and supplementing the revenue of local governments should be maintained under the condition of division market,the equal right and equal price endowed to the rural-urban construction land should be clearly defined in the law,the main entity responsibility of transacting platform on unification market should be confirmed in the practice,the land management system of supervising and using land through certificates should be perfected,and the land circulation benefit disputes in the collective construction land use and land acquisition should be regulated properly,to prevent the negative effect of amalgamation reduction.
