论行政权力清单编制的模块化路径

Study on the Modular Approach to the Compilation of Administrative Power Lists

权力清单的逻辑起点在于对现行行政法律、法规、规章的梳理、确认、清理、归纳,清单编制的过程类似法律汇编的过程,因此权力清单的属性是一种"以法律汇编形式"表现的行政指南。与民事权利体系研究范式相似,"行政主体、行政行为、行政具体事项"作为编制权力清单的逻辑框架,不仅体现了权力清单"实现行政事务的模块化、形式化和标准化"的制度本质意义,也得到了各级地方政府的实践认可。目前各级政府及其部门对行政权力的理解存在差异,模块化编制清单存在诸多问题,如行为模块在分类上主观随意、主体模块中部分行政主体被忽视等。因此,需要从清单的顶层设计、动态管理和司法审查等方面完善权力清单制度,真正实现行政事务的模块化、形式化和标准化。

The logical start point of power lists is combing, confirming,cleaning and concluding the cur-rent administrative law, administrative regulation and administrative rules. The process of compiling pow-er lists is similar to that of codification, which brings out that the nature of the power lists is an adminis-trative guide to the expression “in legal form”. As the frame structure of power lists, “subject, power, object”,which is corresponding to civil rights system,not only reflect the essence of power lists,namely “a-chieving the modularity,formalization and standardization of the administrative affairs”,but also gain the recognition of local governments at all levels via their practices. Currently,compiling power lists modular-ly by local governments has a few problems, for instance the classification of subject module and adminis-trative act modules are casual and rough. Thus, if we would like to improve power list regime and achieve the modularity, formalization and standardization of the administrative affairs truly and exactly, compre-hensive measures must be taken positively. Professional and special law ought to be enacted to design the power lists regime on the top layer. Power lists are obliged to be managed in dynamic. The last but not least,we must push on the judicial review actively.
