论“一国内地区间协议”对特别行政区制度的理论创新

On the Theoretical Innovation of Domestic Inter-District Protocols upon Special Administrative Region System

"一国内地区间协议"伴随我国特别行政区与内地的跨域治理问题而产生,因此在法律性质上属于具有"软法"特征的国内法。"一国内地区间协议"在发展中已经呈现出一定的体系化特征,并表现为不同的法律渊源,在协调不同法域地区的发展方面具有巨大的优势。此外,"一国内地区间协议"在实施效力、实施程序等实施机制方面也具有其特殊性。

Domestic Inter-District Protocols（DIDP）, originating from cooperative administration of crossing districts among special administrative regions and the mainland, features as ＂soft law＂ in the legal nature. The DIDP has presented systematization and is manifested as different legal origins, and has an advantage in coordinating the development of different districts of scope of law. In addition, the DIDP has its own speciality in such aspects as implementing effect and implementing procedure.
