摘要
轻刑化是近年来国际社会的发展趋势。非法集资犯罪是其自身特点和国家政策等众多因素共同作用产生的一种法定经济犯罪。借助轻刑化趋势,在立法、司法和引导其他社会控制手段的完善等方面对非法集资进行规制,有效引导非法集资向合法集资转变,从而服务社会主义市场经济。
Light punishment is the development trend of the intemational community in recent years. Illegal fund - raising is a kind of legal economic crime resulted from the coaetions of its own characteristic, national policy and many other factors. Regulation on illegal fund - raising could be achieved by borrowing the trend of light punishment and improving legislation, justice and other social control means so as to guide illegal fund -raising to legal one and serve for socialism market economy.
